Earth Release?

Watching the anime, I noticed that Tobi was using this technique to burst out of large tree branches, and not just the ground. With that in mind, wouldn't that make it inaccurate to call this technique an Earth Release? He also referred to it as 'Ninpou' rather than 'Doton'. With the rapidity with which he moved around the battlefield to cut off each of Kakashi's group, it seems more likely to be related to his use of Kamui imo.
