Never once do they say the opposite. Considering the last part of your post (that it can't be done when bound), why would Madara risk that? Kabuto is smart, it would be crazy to reincarnate the power of a god without a paper tag ready to take control. Kabuto's main improvement over the jutsu was that he could vary the amount of control on the fly, from basic instructions to full remote control. While Kabuto can't foresee everything, surely "don't attempt to break the jutsu" or some (or multiple) variants thereof would be in place?
For that matter, doesn't every argument against true AI, work for Madara too? That is, does Kabuto have any reason to believe that he can outwit Madara and contain his power, and would he not take every precaution to ensure that Madara tensei had plenty of failsafes to at least try and contain him? Or did it all just rest upon the assumption that Madara's goals aligned with his, even though Madara was dead before he was born and he had no reason to believe it would truly be so? Cause the latter would imply one hell of a gamble.
Furthermore, why would Madara not just do this instantly, taking control over his summoning from the start in stead of bothering with Kabuto at all? Would Kabuto risk the idea that Madara would not be angry for being tensei'd, kill kabuto in an instant and then merrily rampage? Furthermore, Madara only took his own control once the Jutsu was unbound. Considering a Contract is apparently signed both ways (that is, the summoned and the summonee both sign the contract, the latter i assume is done by the DNA needed for tensei ), the Jutsu being undone would then be the only moment that both users can break the contract (Kabuto undid the Contract from his side, then Madara).
Surely it's speculative, and may always remain speculative, but my version both fits the situation, the summoning logic, and has no risk of plotholes whatsoever.
Lastly, i am not sure if it was ever confirmed, but it was my impression that Kabuto actually undid the contract itself, not just the jutsu (since he always stored the tensei in coffins when they were no longer needed)
